Welcome to AskARoofer™! 

These Terms of Use (or "Terms") govern your use of AskARoofer, except where we expressly state that separate terms (and not these) apply and provide information about the AskARoofer Service (the "Service"), outlined below. When you create a AskARoofer account or use AskARoofer, you agree to these terms.  

AskARoofer: We agree to provide you with the AskARoofer Services. The Service includes all of the AskARoofer questions and answers, directories, forum, news, photos, products and any additional information that connects you to the people and products in the roofing industry.  

The Data Policy: Providing our Service requires collecting and using your information. The Data Policy explains how we collect, use, and share information across a AskARoofer websites. 

Who Can Use AskARoofer: We want our Service to be as open and inclusive as possible, but we also want it to be safe, secure, and in accordance with the law, so we need you to commit to a few restrictions in order to be part of the AskARoofer group. 

  • You must be at least 13 years old. 
  • You must not be prohibited from receiving any aspect of our Service under applicable laws or engaging in payments related Services if you are on an applicable denied party listing. 
  • We must not have previously disabled your account for violation of law or any of our policies.  

How You Can't Use AskARoofer 

  • You can't impersonate others or provide inaccurate information. 
  • You have to disclose your identity on AskARoofer, and you must provide us with accurate and up to date information which may include providing personal data. Also, you may not impersonate and you can't create an account for someone else unless you have their express permission. 
  • You can't do anything unlawful, misleading, or fraudulent or for an illegal or unauthorized purpose. 
  • You can't do anything to interfere with or impair the intended operation of the Service. 
  • You can't attempt to create accounts or access or collect information in unauthorized ways. 
  • You can't post someone else’s private or confidential information without permission or do anything that violates someone else's rights, including intellectual property rights (e.g., copyright infringement, trademark infringement, counterfeit, or pirated goods). 

Permissions:  

We do not claim ownership of your content, but you grant us a license to use it. 

When you share, post, or upload content that is covered by intellectual property rights (like photos or videos) on or in connection with our Service, you hereby grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). This license will end when your content is deleted from our systems.  

You give us permission to show your username, profile picture and information about your next to or in connection with accounts, ads, offers, and other sponsored content that you follow or engage. 

Additional Rights We Retain: 

If you select a username or similar identifier for your account, we may change it if we believe it is appropriate. 

You cannot use our property and trademarks or similar marks without our prior written permission. 

You must obtain written permission from us to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us. 

Content Removal and Disabling or Terminating Your Account:

We can remove any content or information you share on the Service if we believe that it violates these Terms of Use, our policies or required to do so by law. We can refuse to provide or stop providing all or part of the Service to you immediately, or if you create risk or legal exposure for us, violate these Terms of Use or our policies.  We can also terminate or change the Service, remove or block content or information shared on our Service, or stop providing all or part of the Service if we determine that doing so is reasonably necessary to avoid or mitigate adverse legal or regulatory impacts on us. If you believe your account has been terminated in error, or you want to disable or permanently delete your account, contact us.   

Disputes

You and we agree that any cause of action, legal claim, or dispute between you and us arising out of or related to these Terms or AskARoofer ("claim(s)") must be resolved by arbitration on an individual basis. Class actions and class arbitrations are not permitted; you and we may bring a claim only on your own behalf and cannot seek relief that would affect other AskARoofer users. If there is a final judicial determination that any particular claim (or a request for particular relief) cannot be arbitrated in accordance with this provision's limitations, then only that claim (or only that request for relief) may be brought in court. All other claims (or requests for relief) remain subject to this provision. 

Instead of using arbitration, you or we can bring claims in your local "small claims" court, if the rules of that court will allow it. If you don't bring your claims in small claims court (or if you or we appeal a small claims court judgment to a court of general jurisdiction), then the claims must be resolved by binding, individual arbitration. The American Arbitration Association will administer all arbitrations under its Consumer Arbitration Rules. You and we expressly waive a trial by jury. 

The following claims don't have to be arbitrated and may be brought in court: disputes related to intellectual property (like copyrights and trademarks), violations of our Platform Policy, or efforts to interfere with the Service or engage with the Service in unauthorized ways (for example, automated ways). In addition, issues relating to the scope and enforceability of the arbitration provision are for a court to decide. 

This arbitration provision is governed by the Federal Arbitration Act:

You can opt out of this provision within 30 days of the date that you agreed to these Terms. To opt out, you must send your name, residence address, username, email address or phone number you use for your AskARoofer account, and a clear statement that you want to opt out of this arbitration agreement, and you must send and received by AskARoofer. 

Before you commence arbitration of a claim, you must provide us with a written Notice of Dispute that includes your name, residence address, username, email address or phone number you use for your AskARoofer account, a detailed description of the dispute, and the relief you seek.  

For any claim that is not arbitrated or resolved in small claims court, you agree that it will be resolved exclusively in the U.S. District Court for the WHERE or a state court located in WHERE. You also agree to submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim. 

The laws of the State of WHERE, to the extent not preempted by or inconsistent with federal law, will govern these Terms and any claim, without regard to conflict of law provisions. 

Unsolicited Material:

We always appreciate feedback or other suggestions, but may use them without any restrictions or obligation to compensate you for them, and are under no obligation to keep them confidential. 

Collection of Information 

Registration Information is the information you submit to register for a Service, for example, to create an account, post comments, receive a newsletter, or enter a contest or sweepstakes. Registration Information may include, for example, name, email address, gender, zip code, household income, political views, and birthday. 

Information from Social Media: 

If you access or log-in to a Service through a social media service or connect a Service to a social media service, the information we collect may also include your user ID and/or user name associated with that social media service, any information or content you have permitted the social media service to share with us, such as your profile picture, email address or friends lists, and any information you have made public in connection with that social media service. When you access the Services through social media services or when you connect a Service to social media services, you are authorizing AskARoofer to collect, store, and use such information and content in accordance with this Privacy Policy. 

Activity Information:

When you access and interact with the Services, we collect certain information about those visits. Our systems receive and record information about your computer, device, and browser, including potentially your IP address, browser type, and other software or hardware information. If you access the Services from a mobile or other device, we may collect a unique device identifier assigned to that device, geolocation data (including your precise location), or other transactional information for that device. 

Cookies:

Tracking technologies (such as browser cookies, pixels, beacons) are comprised of small bits of data. Our website sends this data to your browser when you first request a web page and then store the data on your computer or other device so the website can access information when you make subsequent requests for pages from that service. These technologies may also be used to collect and store information about your usage of the Services, such as pages you have visited, and other content you have viewed. 

Cookies We Use:

Cookies make the use of websites easier by, among other things, saving your preferences. We may also use cookies to deliver content tailored to your interests. Our cookies may enable us to relate your use of our websites to Personal Data that you previously submitted. 

The information that we collect with cookies allows us to statistically analyze usage of websites, and to improve and customize our content and other offerings. However, we only disclose information collected with cookies to third parties on an aggregated basis without the use of any information that personally identifies you. 

How to Control Cookies: 

When you first access a website, you will receive a message advising you that cookies and similar technologies are in use. By closing the message or continuing to browse the website, you signify that you understand and agree to the use of these technologies, as described in this Cookie Policy.  You do not have to accept cookies and consent can be withdrawn at any time, although you may not be able to use certain features on our websites. You can do this by clicking the appropriate opt-out provided in the cookie table above or by activating the settings on your browser that allows you to refuse all or some cookies. 

Security:

AskARoofer uses commercially reasonable administrative, technical, personnel, and physical measures designed to safeguard information in its possession against loss, theft and unauthorized use, disclosure, or modification. However, no one can guarantee the complete safety of your information. 

User Access and Control:

If you would like to access, review, correct, update, suppress, delete, or otherwise limit use of your personal information you have previously provided directly to us, you may contact us.   

Collection of Personal Financial Information: 

In some cases, we may use an unaffiliated payment service to allow you to purchase a products or services.  If you wish to purchase a product or make a payment, you will be directed to a Payment Service webpage. Any information that you provide to a Payment Service will be secured to PCI standards.   

Data Retention:

We will retain your information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law. 

California Consumer Privacy Act Notice:

This California Consumer Privacy Act Notice Section provides information for California residents in connection with the California Consumer Privacy Act (“CCPA”). Under the CCPA, and for purposes of this Section, “Personal Information” generally means information that identifies, relates to, or describes a particular California resident.   

We do not knowingly “sell” Personal Information of minors under 16 years of age  

Sources of Personal Information. We collect this Personal Information directly from California residents themselves, as well as from social media platforms joint marketing, co-branding, co- promotional, or advertising partners; and sources of demographic and other information.

If you are a California consumer, you have the following rights:

You have the right to request that we disclose to you the following information: 

The categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information during the 12 months prior to your request; 

The specific pieces of Personal Information we collected about you during that time period; 

The business or commercial purpose for collecting, disclosing, or selling Personal Information about you; 

The categories of Personal Information about you that we sold and the categories of third parties to whom we sold that Personal Information; and 

The categories of Personal Information about you that we otherwise shared or disclosed and the categories of third parties with whom we shared or disclosed that Personal Information. 

Right to Request Deletion.

You have the right to request that we delete Personal Information we collected from you. 

Right to Opt-Out of Sale.

As noted above in this section, we share some categories of Personal Information in connection with certain types of advertisements. Because interest-based advertising relies on cookies and other similar technologies, opting out needs to be controlled at the device and/or browser level.  

Right to be Free from Discrimination.

You have the right to be free from unlawful discrimination for exercising your rights under the CCPA. 

Updating Terms and Conditions, Privacy Policy and Cookie Usages Policy: 

We may change our services, and we may need to make changes to these policies.  Unless otherwise required by law, we will update the pages on the AskARoofer website.  If you continue to use the Service, you will be bound by the updated Terms. If you do not want to agree to these or any updated Terms, you can delete your account, here. 

ARBITRATION NOTICE:

YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.  

 

Responsible AI Usage

Artificial Intelligence (AI) is an important tool in marketing and content development. It must be used transparently and ethically, and this guide ensures that The Coffee Shops crew members use of AI aligns with our values and our customers’ goals and rights.   

Guidelines for responsible AI usage   

Transparency - It's crucial that we remain transparent about our use of AI. This includes acknowledging when AI has been used to create or modify content. This can be through a blanket statement on our website or integrated into contracts with clients.   

At The Coffee Shops, AI is used to assist in the development of some content, but it is never used to fully automate the creation of content. It is used to help generate ideas and in cases provide summaries of other content to assist in article writing. We ensure that every piece of content we develop is shaped and reviewed by people who have an understanding of the audience and AI’s limitations.   

Accountability - Responsibility cannot be outsourced to a machine. Always remember that humans are ultimately accountable for the actions of the AI. AI is an assistant, not a replacement for good judgment. Our company policy is that we should NEVER publish or send something that has been written entirely by AI without human development or review for quality and accuracy. Additionally, in case of any negative outcomes from AI-assisted content, we must take responsibility and remediate as necessary.   

Privacy - We must protect the privacy of our customers. We will not submit confidential or unpublished information from our customers.  

Ethical considerations - AI should not be used to mislead or manipulate customers. All content created using AI should be ethical and in line with our corporate values. AI content should go through a review process to check for bias, inaccuracies and other risks.   

Training employees on AI usage - All employees involved in creating content with AI will receive appropriate training. This should cover both the technical aspects of using AI, and the ethical considerations outlined in this policy.
